Terms of Service
Effective October 29, 2026
These Terms of Service ("Terms") are an agreement between Lynxedo LLC ("Lynxedo," "we," "us" or "our"), the maker of Servanto, and the business that signs up for Servanto ("Subscriber," "you" or "your"). They cover the Servanto web, mobile and desktop apps, the browser extension, the AI receptionist and related services (together, the "Service"). By signing up, signing in or using the Service, you agree to these Terms. If you accept them for a company, you confirm you have authority to bind that company.
The short version
- Your data is yours. We use it only to run your account, and never to compete with you.
- You are responsible for your users, and for having consent to call, text and record your customers.
- Our internet phone service has limits on 911 calling. Keep another way to call 911.
- You can cancel any time. You get 30 days to export your data, and then we delete it.
1. Accounts and users
You choose who on your team can use the Service and what each person can see and do. You are responsible for your users' actions in the Service, for keeping sign-in methods secure, and for telling us promptly if you think an account has been misused. Users must be at least 16 years old. If you sign up through another company's app marketplace, these Terms still govern your use of the Service.
2. Your data
"Your Data" means everything you or your users put into the Service or bring in from connected services: customer and job records, messages, calls, recordings, files and settings. You own Your Data. You give us permission to host, copy, process and display Your Data only as needed to provide, secure and support the Service for you, and as described in our Privacy Policy.
No competitive use. We will not use Your Data to analyze, benchmark or compete with your business, and we will not give it to anyone else for those purposes. Lynxedo's owner also operates a lawn care and irrigation company. That company uses Servanto as a subscriber under these same Terms and has no access to any other subscriber's data.
You are responsible for Your Data being accurate and lawful, and for having the rights and consents needed to put it into the Service.
3. How we process your data
For personal information in Your Data, you are in control of the data and we are your service provider (a "processor"). We agree to:
- process it only to provide the Service and on your documented instructions, which these Terms and your settings in the Service represent;
- not sell or share it, or use it for any purpose outside our relationship with you;
- require everyone who works on the Service to keep it confidential;
- protect it with reasonable technical and organizational security measures;
- use only the sub-processors listed in our Privacy Policy, bind each to data protection terms at least as protective as these, and give notice before adding a new one so you can object;
- notify you without undue delay, and within 72 hours, after confirming a security breach that affects your personal information, and help you meet your own notification duties;
- help you respond to requests from people exercising their privacy rights; and
- return or delete the data when the Service ends, as described in section 10.
If you need a separately signed data processing agreement, email us.
4. Connected services
The Service can connect to other software you use, such as field-service scheduling, accounting, payroll, fleet GPS and advertising platforms ("Connected Services"). By connecting one, you authorize us to read and write data in it for you, as the features you use require. Connected Services are provided by other companies under their own terms. We are not responsible for them, for their availability or for changes they make that affect the Service.
You can disconnect a Connected Service at any time, from the Service or from the Connected Service itself. When you do, we delete its access keys and stop syncing right away. Data we copied from it is deleted within 30 days, unless you reconnect in that time or ask us in writing to keep it.
5. Calls, texts and recording
When you use the Service to call, text or email people, you are the sender and you are responsible for following the law. This includes the Telephone Consumer Protection Act, CAN-SPAM, state telemarketing and texting laws, carrier rules and do-not-call rules. In particular:
- You must have the consent the law requires before texting or calling customers and leads, especially for marketing, and you must honor opt-outs. The Service processes STOP replies automatically, and you must not work around them.
- Call recording: some states, such as California, Florida, Illinois, Maryland, Massachusetts, Pennsylvania and Washington, require every party's consent to record a call. If you turn on recording or the AI receptionist, you are responsible for giving any required notice and getting any required consent. You must keep the recording announcement on where the law requires it.
- You must give us accurate business information for phone carrier registration, and keep it up to date. We may pause sending if a carrier or regulator requires it.
- Phone numbers we provide stay assigned to your account while you subscribe. If you leave, we will help you move ("port") numbers you are entitled to keep to another provider, as long as your account is paid up.
6. 911 and emergency calls
The Service's internet calling is not a replacement for a regular phone for emergency calls.
911 calls placed through internet calling may not work during a power or internet outage, may not connect, or may send emergency services the wrong location. This is especially true if you use the Service away from the address registered for your number. You must give us and keep current a registered address for each phone number, tell your users about these limits, and keep another way to reach 911, such as a mobile phone. To the extent the law allows, Lynxedo is not liable for any failure to reach emergency services through the Service.
7. AI features
The Service includes AI features, including an AI receptionist that can talk and text with your customers for you. You decide whether to turn these on and how they are set up. AI output can be wrong or incomplete. You are responsible for reviewing it and for what the AI receptionist says and does on your behalf within the settings and instructions you give it. We do not use Your Data to train AI models.
8. Acceptable use
You will not, and will not let anyone else:
- use the Service for anything unlawful, fraudulent, harassing or deceptive, or to send unsolicited messages;
- break into, overload or interfere with the Service or other subscribers' data;
- copy, resell or reverse engineer the Service, or use it to build a competing product;
- share sign-ins between people or get around usage limits or permissions; or
- upload malware, or content you have no right to use.
We may suspend access to stop a violation or a security threat, or if a carrier or regulator requires it. We will tell you and restore access as soon as the problem is fixed.
9. Fees and billing
Fees are set out in your order, invoice or plan. They are based on the features you choose plus any usage charges, such as phone minutes and texts. Unless your order says otherwise, invoices are due within 15 days. Fees do not include taxes, which you pay except for taxes on our income. We may change prices with at least 30 days' notice, effective at your next billing period. If an invoice is more than 30 days overdue, we may suspend the Service after giving you notice. Fees already paid are not refundable, except where these Terms or the law say otherwise.
10. Term, cancellation and data export
These Terms last as long as you use the Service. You may cancel at any time; unless your order says otherwise, cancellation takes effect at the end of the current billing period. We may end the Service with 30 days' notice, or right away if you materially breach these Terms and don't fix it within 10 days of notice.
Data export: for 30 days after the Service ends, you can ask us for an export of Your Data in a standard format, such as CSV files plus your stored recordings and files. After that, we delete Your Data from our live systems. Backup copies are removed as backups expire, within 90 days. Sections 2, 3, 6 and 11 to 15 continue after the Service ends.
11. Our property
The Service, including the software, design, Servanto name and logos, belongs to Lynxedo and its licensors. These Terms give you the right to use the Service while you subscribe, not ownership. If you send us suggestions, we may use them without any obligation to you.
12. Disclaimers
We work hard to keep the Service reliable and will fix problems with reasonable care. Otherwise, the Service is provided "as is" and "as available." To the extent the law allows, we disclaim all other warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that Connected Services, phone carriers or AI output will be available or accurate.
13. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Each party's total liability under these Terms is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to your payment obligations, to either party's indemnity obligations, or to liability that cannot legally be limited.
14. Indemnity
You will defend and indemnify Lynxedo against third-party claims arising from Your Data, or from calls, texts, emails or recordings sent or made through your account, including claims under the laws described in section 5. We will defend and indemnify you against third-party claims that the Service, as we provide it, infringes their intellectual property. The party seeking indemnity must give prompt notice and reasonable cooperation.
15. General terms
- Governing law: these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Texas.
- Changes: we may update these Terms. If a change is significant, we will give administrators at least 30 days' notice by email or in the app. Continuing to use the Service after that means you accept the change.
- Notices: we send notices to your account administrator's email. You send notices to the address below.
- Assignment: neither party may transfer these Terms without the other's consent, except as part of a merger or sale of the business.
- Events beyond control: neither party is responsible for delays caused by things outside its reasonable control, such as carrier or internet outages or natural disasters.
- Whole agreement: these Terms, your order and the Privacy Policy are the entire agreement. If they conflict, your signed order wins, then these Terms. If any part is unenforceable, the rest still applies. Not enforcing a term is not a waiver of it.
